These Terms & Conditions (“Terms”) govern your access to and use of this real estate marketplace website and related services (the “Platform”) operated by NRK Associates (“we”, “us”, or “our”).
By creating an account, browsing listings, posting property, purchasing a package, or otherwise using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1. About the Platform
The Platform is an online marketplace that helps users discover, list, and inquire about properties for sale or rent. NRK Associates provides technology and facilitation services. Unless expressly stated otherwise, we are not a party to any transaction between buyers, sellers, tenants, landlords, or agents.
2. Eligibility
- You must be at least 18 years old and legally capable of entering into a binding contract
- You must provide accurate, complete, and current registration information
- You are responsible for safeguarding your account credentials and for all activity under your account
3. Accounts and profiles
- You may register using email/password or an enabled third-party login (such as Google)
- You agree to keep your contact details updated so we and other users can reach you when needed
- We may suspend or terminate accounts that violate these Terms, appear fraudulent, or create risk for other users
4. Property listings
4.1 Seller responsibilities
If you post a listing, you represent and warrant that:
- You are the owner of the property or are authorized to list it
- All listing information, photos, pricing, and availability are accurate and not misleading
- Your listing complies with applicable local, state, and national laws
- You will not post illegal, offensive, discriminatory, or infringing content
4.2 Review and visibility
- Listings may be reviewed before going live and can be approved, rejected, edited for clarity, hidden, or removed by us
- Listing visibility may depend on an active subscription/package, payment status, and compliance with these Terms
- We do not guarantee that a listing will generate inquiries, leads, or completed transactions
5. Inquiries and contact sharing
Users may submit inquiries to unlock or request owner contact details. You agree to provide truthful inquiry information and to use obtained contact details only for legitimate property-related communication. Misuse of contact data (spam, harassment, fraud, or unrelated marketing) is prohibited and may result in account action.
6. Packages, payments, and refunds
- Seller packages, listing limits, and durations are as described on the Platform at the time of purchase
- Payments are processed by third-party payment gateways; their terms may also apply
- Fees are generally non-refundable once a package is activated, except where required by law or expressly stated by NRK Associates in writing
- Unused listing slots may expire when a subscription period ends, as per the package terms shown at checkout
7. Acceptable use
You agree not to:
- Use the Platform for unlawful, fraudulent, or deceptive purposes
- Scrape, harvest, or automate access to listings or user data without permission
- Interfere with Platform security, performance, or other users’ access
- Upload malware or attempt unauthorized access to systems or accounts
- Impersonate another person or misrepresent your affiliation or authority
- Post duplicate spam listings or content that violates intellectual property or privacy rights
8. Intellectual property
The Platform’s design, software, trademarks, logos, and original content are owned by or licensed to NRK Associates and are protected by applicable intellectual property laws. You retain ownership of content you submit, but you grant NRK Associates a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and promote the Platform.
9. No brokerage guarantee / disclaimer
NRK Associates provides an online marketplace and related tools. We do not guarantee the accuracy of user-submitted listings, the identity or creditworthiness of users, property condition, title, legal status, or the outcome of any negotiation or transaction. Users should independently verify property details and seek professional advice (legal, financial, or otherwise) before entering into any agreement.
10. Limitation of liability
To the maximum extent permitted by law, NRK Associates and its partners, officers, and staff are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Platform. Our total liability for any claim relating to the Platform shall not exceed the fees you paid to us for the specific paid service giving rise to the claim in the three (3) months preceding the claim.
11. Indemnity
You agree to indemnify and hold harmless NRK Associates from claims, losses, damages, and expenses (including reasonable legal fees) arising out of your content, listings, misuse of the Platform, violation of these Terms, or infringement of any third-party rights.
12. Suspension and termination
We may suspend, restrict, or terminate access to the Platform or remove content at any time if we reasonably believe you have violated these Terms, created risk, or if required for legal or operational reasons. You may stop using the Platform at any time. Provisions that by nature should survive (including intellectual property, liability limits, and indemnity) will continue after termination.
13. Changes to the Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of India. Subject to applicable law, courts having jurisdiction at the place of business of NRK Associates shall have exclusive jurisdiction over disputes arising from these Terms or the Platform.
